Terms & Conditions

1. Introduction

These Terms & Conditions govern all bookings arranged through MARY'S AGENCY s.r.o. ("the Company") for luxury villa rentals and concierge services in Spain and surrounding areas.

By confirming a reservation, the guest agrees to comply with these Terms & Conditions.

2. Booking Confirmation

2.1 All reservations are subject to availability and written confirmation.

2.2 A reservation is considered confirmed only after:

  • written acceptance by the Company; and
  • receipt of the required payment according to the booking agreement.

2.3 The lead guest making the reservation must be at least 25 years old.

3. Rental Period

3.1 The minimum rental period is 7 consecutive nights.

3.2 Shorter stays may only be accepted at the Company's sole discretion during selected periods.

3.3 Check-in and check-out times will be communicated before arrival.

4. Occupancy Policy

4.1 The maximum permitted occupancy is strictly limited to 2 guests per bedroom/room.

4.2 Exceeding the approved occupancy is prohibited unless previously authorized in writing.

4.3 Unauthorized guests, parties, or events may result in:

  • immediate cancellation of the booking;
  • removal from the property;
  • forfeiture of all payments made.

5. Payments

5.1 All payments must be made exclusively by bank transfer.

5.2 Payment is made directly to the villa owner or designated property holder specified in the booking confirmation.

5.3 The Company acts as an intermediary and marketing representative between the guest and the property owner.

5.4 The property owner is responsible for paying any agreed commission to the Company separately.

5.5 Reservations are not guaranteed until cleared funds are received.

5.6 Failure to complete payment within the agreed timeframe may result in cancellation of the reservation.

6. Security Deposit

6.1 A refundable security deposit may be required prior to arrival.

6.2 The deposit may be used to cover:

  • damages;
  • excessive cleaning;
  • missing items;
  • breach of house rules;
  • unauthorized occupancy.

6.3 Any remaining balance will be returned after property inspection.

7. Cancellation Policy

7.1 All cancellations must be submitted in writing 15 days before check-in date.

7.2 Cancellation charges may apply depending on the notice period and specific property terms.

7.3 No refunds will be provided for:

  • no-shows;
  • unused nights;
  • early departures;
  • reductions in guest numbers.

8. Guest Responsibilities

8.1 Guests agree to:

  • respect the property and neighboring residences;
  • maintain reasonable noise levels;
  • comply with all local laws and villa rules.

8.2 Smoking inside the villa is prohibited unless explicitly permitted.

8.3 Illegal activities, excessive noise, or disruptive behavior are strictly forbidden.

8.4 Guests are responsible for the conduct of all persons staying at or visiting the property during the rental period.

9. Concierge & Additional Services

9.1 Additional luxury concierge services can be arranged upon request, including:

  • airport transfers;
  • private drivers;
  • catering services;
  • private chefs;
  • housekeeping;
  • yacht charters;
  • security services;
  • event planning.

9.2 Airport transfer and catering services may be provided for the entire duration of the stay.

9.3 All concierge services are subject to availability and additional charges unless otherwise agreed in writing.

9.4 Third-party service providers operate independently and the Company shall not be liable for services provided by external suppliers.

10. Liability Disclaimer

10.1 Guests use the property and all facilities entirely at their own risk.

10.2 The Company and property owner shall not be liable for:

  • accidents;
  • injuries;
  • theft;
  • loss of personal belongings;
  • temporary utility interruptions;
  • internet outages;
  • force majeure events.

10.3 Guests are strongly advised to obtain comprehensive travel insurance.

11. Force Majeure

Neither the Company nor the property owner shall be held responsible for delays, cancellations, or inability to fulfill obligations caused by events beyond reasonable control, including:

  • natural disasters;
  • weather conditions;
  • government restrictions;
  • pandemics;
  • strikes;
  • utility failures;
  • transportation disruptions.

12. Privacy

Guest information will be treated confidentially and used solely for booking management, legal compliance, and customer service purposes.

13. Governing Law

These Terms & Conditions shall be governed by the laws of Spain.

Any disputes arising in connection with bookings or stays shall be subject to the jurisdiction of the courts of Spain.

14. Acceptance

By confirming a reservation, the guest confirms they have read, understood, and accepted these Terms & Conditions.
